Agreement

This app and the services available in connection with it ("Pace") are made available to you by Myndarc, LLC ("Myndarc", "we", "us") subject to these Terms of Use and the Privacy Policy (collectively, the "Terms"). By using Pace, you agree to be bound by these Terms. If you do not agree, please do not use Pace. We reserve the right to modify these Terms at any time. Continued use of Pace after changes constitutes acceptance.

Medical Disclaimer

Pace provides health-related information for educational and informational purposes only. It is not medical advice and should not be treated as such. Pace is not a substitute for professional medical advice, diagnosis, or treatment. Always consult your physician or qualified healthcare provider with any questions about a medical condition. Never disregard professional medical advice or delay seeking treatment because of information presented in Pace. If you think you may have a medical emergency, call your doctor or 911 immediately.

Health Data

Pace reads data from Apple Health with your permission. All health data processing happens on your device. Pace does not upload, store, or transmit your health data to any external server. The AI health assistant runs entirely on-device using Apple Intelligence. Pace only reads data from Apple Health — it does not write to or modify your health records except for journal tags you explicitly choose to save.

Subscriptions & Payments

Pace offers optional auto-renewing subscriptions billed through your Apple ID. Subscription fees are charged in advance at the start of each billing period and auto-renew until cancelled. You can manage or cancel subscriptions in your device's Settings > Apple ID > Subscriptions. Cancellation takes effect at the end of the current billing period. No refunds are provided for unused portions of a subscription period.

Disclaimer of Warranties

Pace is provided "as is" without warranty of any kind. We do not guarantee that Pace will be uninterrupted, error-free, or that results obtained from Pace will be accurate or reliable. Pace is not providing medical advice. The content in Pace should not be used in place of advice from your physician or other medical professional.

Limitation of Liability

To the fullest extent permitted by law, Myndarc and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Pace, including but not limited to health decisions made based on information presented in the app.

Intellectual Property

Pace, its design, code, and content are owned by Myndarc, LLC. You are granted a personal, non-transferable, non-exclusive license to use Pace. You may not copy, modify, distribute, reverse engineer, or create derivative works from Pace.

Termination

We may terminate or suspend your access to Pace at any time for violation of these Terms or for any other reason at our sole discretion, without prior notice.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Santa Clara County, California.
